S&W Secures Section 366 Adequate Protection for the City of Adrian

John Stockdale, Jr. and Jeffery Sattler represent the City of Adrian, Michigan in a jointly administered chapter 11 pending in the Bankruptcy Court for the Western District of Wisconsin. The City provides water and sewer utility services to the debtors’ egg drying facility. Jeff and John quickly prepared objections to the debtors’ first day motions to use cash collateral and provide adequate assurance of performance to utility providers, which John argued at the first day hearings a day later. As a result of S&W’s quick work, the City was awarded adequate protection in amount 200% of the Debtors proposal, all without losing any of the security provided by Michigan Law, MCL § 123.162, to municipal providers of water and sewer services.
